Terms & Conditions and Right of Withdrawal

There is no right of withdrawal within the meaning of the Consumer Protection Code – however, we grant you the following cancellation conditions:

Booking and Cancellation Conditions pursuant to Art. 1382 of the Italian Civil Code (ZGB / Codice Civile):
The booking becomes binding once the required deposit (approx. 30%) has been paid. This deposit is non-refundable in the event of a cancellation. In case of late arrival or premature departure, the apartment will be charged for the entire booked period. Furthermore, the apartment will be billed based on the number of persons booked.

In the event that something unexpected happens and you are unable to start your journey, the following cancellation conditions apply:

• Up to 31 days before arrival: A fee of 30% of the total booked amount will be charged.

• Within 30 to 8 days before arrival: A fee of 70% of the total booked amount will be charged.

• Within 7 days before arrival: A fee of 100% of the total booked amount will be charged.

The booked number of persons, including ages and days, is strictly binding.

Pets:
A maximum of one permitted pet of any kind and size must be registered in advance. Surcharge: €20 per day. In the event of a violation of the registration requirement, the maximum number of pets, or the general ban in the rented unit, we will charge a fee of €30 per pet/day.

Payment:
We accept cash payments and bank transfers. Bank transfers must be received in our account prior to departure. Cash payments are possible up to a maximum amount of €2,999.

Arrival and Departure:
We kindly ask you to plan your arrival and departure as follows:

• Check-IN: 3:00 PM – 9:00 PM

• Check-OUT: 7:00 AM – 9:00 AM

• Sundays Check-IN: 5:00 PM – 9:00 PM

• Early Check-In or Late Check-Out can be booked for an additional fee.

Local Tourist Tax (Ortstaxe):
As of January 1, 2014, a local tourist tax has been introduced in South Tyrol. The revenues from this tax are used for the expansion and maintenance of infrastructure and services, as well as for organizing cultural and sporting events. The tourist tax is collected by the accommodation provider per guest and night. The amount of this municipal tax depends on the category of the establishment. Children and adolescents under 14 years of age are exempt from this tax. The tourist tax is due upon departure and is listed separately on the invoice. Please present an identification document for your children under 14 years of age; otherwise, the exemption cannot be applied.

The guest is explicitly referred to the legal provisions of Articles 45-67 of the Italian "Consumer Protection Code" (GvD 206/2005).

Security Deposit:
For your safety and ours, we request a security deposit upon arrival. This will be refunded within 8 days after your departure, provided the accommodation is left in proper condition. For short stays of up to 4 days, the deposit is 20% of the total stay price; otherwise, it is 10% of the total stay price.

 

 

House Rules

1. Cleaning: The apartment must be left swept clean. Waste must be separated and disposed of according to the regulations.

2. Quiet Hours: No parties are allowed. Quiet hours must be observed from 9:00 PM onwards.

3. Dogs:

   • No dogs allowed on beds or sofas.

   • Dog waste must be picked up.

   • Dogs must be kept on a leash outdoors.

   • Dogs must not be left unattended in the apartments.

   • The guest is liable for any damage or non-compliance. In the event of a violation of the dog regulations, the guest is liable at the sole discretion of the landlord.

4. Day Visitors and Guests:
   Day visitors must be registered in advance. A fee of €15.00 per person/day will be charged for the use of the holiday apartment and the farm infrastructure (including parking space, playground, terrace, and sun loungers). If the registration requirement is missed, the host is entitled to subsequently add the identified day visits to the final invoice at a fee of €25.00 per person/day without prior consultation.

5. Included Services & E-Charging:
   The agreed accommodation price includes bed linen, towels, final cleaning, and all utilities (electricity, water, heating, but excluding the charging of electric vehicles). The charging of electric vehicles is permitted upon request and will be billed based on your maximum charging capacity and our latest known electricity costs per kWh.

Guest Pass

Upon completion of the accommodation contract, the guest will be issued the "Südtirol Alto Adige Guest Pass" (hereinafter referred to as the Guest Pass), which, according to the South Tyrolean Provincial Government Decree No. 732/2022, is valid for the entire duration of their stay, from 12:00 AM on the day of arrival until 11:59 PM on the day of departure.

• The Guest Pass includes the use of all public transport within the "südtirolmobil" network area, as well as additional services that vary by tourism organization. Detailed information can be found at: suedtirol-guestpass.info

• The sole province-wide issuer of the Guest Pass is the Mobility Consortium (Mobilitätskonsortium), which was appointed as the uniform coordinating body by the Association of Tourism Organizations of South Tyrol (LTS) on November 16, 2022, in accordance with the aforementioned provincial government decree. The details of the additional services associated with the Guest Pass and its terms of use are communicated by the third party responsible for issuing and managing the Guest Pass. Draft text to be used in accordance with the General Data Protection Regulation (GDPR) and integrated into the privacy policy:

• Purpose: The transmitted personal data will be forwarded to the uniform coordinating body of the Guest Pass to enable the creation and use of the Guest Pass and to provide the associated services.

• Recipient: In connection with the issuance of the Guest Pass, your data will be transmitted to the Mobilitätskonsortium (VAT No. 02735170215), which acts as the card issuer and uniform coordinating body in the role of an autonomous data controller for processing the transmitted data. For further information regarding the processing of your data, you can send an email to privacy@moko.bz.it.

• Legal Basis: The legal basis for processing is Art. 6(1)(b) of the GDPR. Due to data protection regulations, we only issue the Guest Passes after a successful online check-in.

Local Tourist Tax Amount:
As of January 2025: Euro 2.50 per person and day for guests aged 14 and over.

By paying the deposit upon booking, I give my consent to the processing of all personal data as described above. This declaration applies to all our guests. We hereby inform you about the type, scope, and purpose of the collection and use of your personal data.

Pursuant to Art. 13 of the European General Data Protection Regulation, we process the following data:

• Your master data and that of your fellow travelers (first name, last name, address, telephone, email, date of birth, place of birth, language, etc.).

• Your data from travel documents and identity cards.

• Your data regarding payments, debit cards, credit cards, and bank cards.

• The duration of stay requested by you, as well as personal preferences associated with the stay that you disclose to us.

The data will be stored and processed by us to provide our services and, where necessary and required by law, transmitted to third-party recipients (e.g., public authorities, tourism associations). Your data will not be transferred to third countries. Should you refuse to provide master data, travel document data, or banking data, it will not be possible for us to fulfill our contractual obligations and accommodate you in our establishment.
