Terms and Conditions & Right of Withdrawal
There is no right of withdrawal as defined by the Consumer Protection Code; however, we offer the following cancellation policy: Booking conditions, cancellation policy according to Art. 1382 of the Italian Civil Code: The booking is binding once the required deposit (approx. 30%) has been paid, which is non-refundable in case of cancellation. In case of late arrival or early departure, the apartment will be charged for the booked period. The apartment will also be charged for the number of people booked. In the event of unforeseen circumstances preventing you from traveling, the following conditions apply:

For cancellations up to 31 days before arrival, fees of 30% of the total booked amount will apply.

For cancellations made between 30 and 8 days prior to arrival, a fee of 70% of the total booking amount will be charged.

For cancellations within 7 days of arrival, fees amounting to 100% of the total booking amount will apply.

The number of people booked, including their ages and the dates of stay, is binding.
A maximum of one pet of any type and size is permitted and must be registered in advance. There is a surcharge of €20 per day. If the registration requirement, the maximum number of pets, or any prohibitions in the rented unit are violated, we will charge €30 per pet per day.
To save costs and protect yourself, we recommend our Roter Hahn cancellation insurance. Click here (http://partner.europaeische.at/roter-hahn?AGN2=146178710) to purchase your own travel insurance. We accept cash payments and bank transfers, with payment being received in our account before departure. Cash payments are limited to a maximum of €2999.

Arrival and Departure: We kindly ask you to plan your arrival and departure accordingly: Check-in: 3:00 PM - 9:00 PM; Check-out: 7:00 AM - 9:00 AM, Sundays: Check-in: 5:00 PM - 9:00 PM. Early check-in or late check-out can be booked for an additional fee. Tourist Tax: As of January 1, 2014, a tourist tax has been introduced in South Tyrol. The revenue from this tax is used for the development and maintenance of infrastructure and services, as well as for the organization of cultural and sporting events. The tourist tax is collected by the accommodation providers per guest per night. The amount of this municipal tax depends on the category of the establishment. Children and young people under 14 years of age are exempt from the tax. The tourist tax is due upon departure and is shown separately on the bill. Please provide us with identification for your children under 14 years of age; otherwise, the exemption cannot be applied.
The guest is expressly advised of the legal provisions of Articles 45-67 of the Italian “Consumer Protection Code” Legislative Decree 206/2005.

For your and our security, we require a security deposit upon arrival. This will be refunded within 8 days of your departure, provided the accommodation is left in good order. The deposit is 20% of the total price for short stays of up to 4 days, and 10% for longer stays.

House Rules
1. Cleaning: The apartment must be left swept clean. Garbage must be separated and disposed of according to regulations.
2. Quiet Hours: No parties. Quiet hours begin at 9:00 PM.
3. Dogs:
No dogs allowed on beds or sofas.
Please pick up after your dog.
Dogs must be kept on a leash outdoors.
Dogs must not be left unattended in the apartments.
The guest is liable for any damage or non-compliance. In the event of a violation of the no-dogs rule, the guest will be held liable at the landlord's discretion.
4. Guests: Only registered guests are permitted on the premises. It is not permitted to invite additional people, even during the day.

Guest Pass:
Upon completion of the accommodation contract, the guest will be issued the South Tyrol Alto Adige Guest Pass (hereinafter referred to as the Guest Pass), which, according to the South Tyrol Provincial Government's Decree No. 732/2022, is valid for the entire duration of their stay and from 0:00 on the day of arrival until 24:00 on the day of departure. The Guest Pass includes the use of all public transport within the Südtirolmobil network area, as well as additional services, which vary depending on the tourism organization. Detailed information can be found at: suedtirol-guestpass.info. The sole South Tyrol-wide provider of the Guest Pass is the Mobility Consortium, which was appointed as the unified coordinating body by the South Tyrol Tourism Organizations Association (LTS) on November 16, 2022, in accordance with the aforementioned Provincial Government decree. Details of the additional services associated with the Guest Pass, as well as the terms of use, will be provided by the third party responsible for issuing and managing the Guest Pass. Detailed information can be found at: suedtirol-guestpass.info. This is a draft text to be used in accordance with the General Data Protection Regulation (GDPR) and integrated into the privacy notice. Purpose: The personal data transmitted will be transferred to the single coordination point of the Guest Pass to enable the creation and use of the Guest Pass and to provide the associated services. Recipients: In connection with the issuance of the Guest Pass, your data will be transferred to the Mobility Consortium with VAT number 02735170215, which, as the Guest Pass holder and single coordination point, acts as the autonomous data controller for the processing of the transmitted data. For further information about the processing to which the data is subject, you can write an email to privacy@moko.bz.it . Legal basis: The legal basis for the processing is Art. 6 para. 1 letter b) of the GDPR. For data protection reasons, we only issue the Guest Passes after successful online check-in.

 

Tourist tax:
from January 2025: €2.50 per person per day (from age 14)

Your data will not be transferred to third countries. Should you refuse to provide personal data, travel document details, and bank details, we will be unable to fulfill our contractual obligations and accommodate you at our establishment. We do not use profiling or automated decision-making. The legal bases for these data processing operations are: - the fulfillment of our pre-contractual and contractual obligations to you; - your consent;
- legal, contractual, or other legal obligations on our part (e.g., documentation rights and obligations under accounting, tax, and customs law, contract law, reporting requirements, or legal disputes); - our legitimate interests (e.g., improving our customer service, including direct marketing, or pursuing our own legal interests).
The duration of data storage is determined by the length of our business relationship, the consents you have given, and also by the statutory retention periods and legal obligations applicable to us. You can request information about your personal data stored by us at any time, free of charge. As a data subject, you also have the right to withdraw your consent, access, erasure, rectification, restriction of processing, and data portability of your personal data, provided that this does not conflict with any statutory retention obligations on our part. If you exercise your right to withdraw your consent, all your data will be irrevocably deleted, unless this violates overriding legal provisions. Data protection information regarding video surveillance

2. Purpose and legal basis
Video surveillance is carried out to protect persons and property (vandalism, theft, safety of guests and employees).

Legal basis: The legitimate interest of the controller (Art. 6 para. 1 lit. f GDPR). Guest consent is not required, as the signs are correctly positioned.

3. Scope and storage

  • The cameras only record publicly accessible outdoor areas of the premises (e.g., entrance, hallways, parking lot). Private areas (indoors, rooms, restrooms) are not monitored.

  • Storage period: The images are automatically deleted after 7 days. Longer storage (up to a maximum of 7 days) only occurs on public holidays or upon explicit order of the judicial or police authorities.

4. Recipients of the data:
The recordings are only accessible to authorized personnel. They will only be shared with security authorities in the event of criminal offenses.

5. Your rights
You have the right to information (access to the images, provided you are identifiable), erasure (in case of unlawful storage) and restriction of processing.
